is a Native Floridian, the fifth of 8 children. If not in school, Judge McNicholas was expected to work in the family construction business. This extended into Judge McNicholas’ law school days. When students interned with law firms for summer, Judge McNicholas worked in the construction business with his family. This work ethic instilled by Judge McNicholas’ parents remains with him today.
Judge McNicholas graduated the University of Florida in 1987 and Stetson University College of Law in 1990 cum laude. He was an Associate Editor of the Stetson Law Review.
Judge McNicholas has worked his entire 25-year legal career on the Treasure Coast. Judge McNicholas started as an Assistant State Attorney under Bruce Colton, and served as General Counsel for SunTrust, focusing on commercial litigation, creditor’s rights, and bankruptcy. He led his own Law Office for several years before joining McCarthy, Summers law firm in 2008. As a Partner he focused on real estate and commercial litigation, real estate transactions, and land use and zoning.
Judge McNicholas and his wife of 22 years have three teen boys. His wife has been a school teacher for 15 in Martin County.
Judge McNicholas has been a Certified Circuit Civil Mediator for the past 9 years and successfully mediated many cases during that time. Judge McNicholas also served as a Traffic Hearing Officer for the 19th Circuit prior to being elected Circuit Court Judge in November, 2016. He is currently assigned to the Family Division in Martin County, Florida.
